Facebook is using facial recognition on people’s photos to spot other users in them. Federal judge James Donato has ruled that Facebook must face a major lawsuit over the way the sites’ facial recognition tools work, namely without permission of the users. Before a class action lawsuit can proceed, the class must be certified. This process ensures that the plaintiffs have enough similarities to proceed with litigation against the defendant. In San Francisco federal court, the judge has given green light: he ruled that a class action is the most efficient way to resolve the dispute over facial templates.
